Terms of Service

1. Acceptance of these terms

HOVERBALL is a free online game operated by Volter (“HOVERBALL”, “we”, “us”, “our”).

By downloading, accessing, or playing HOVERBALL — through our game client, this website, or any related online service (together, the “Game”) — you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Game.

2. The Game is free

HOVERBALL is provided free of charge. There are no purchases, no payments, and no paid content of any kind. We do not ask you for payment information to play.

3. Your account

You may need an account to play. You are responsible for keeping your credentials secure and for all activity that occurs under your account. You agree to provide accurate information, and you confirm that you are at least 13 years old (or the minimum age required in your country). Notify us at support@volter.ai if you believe your account has been compromised.

4. Fair play & acceptable use

HOVERBALL is a competitive multiplayer game. You agree not to:

• cheat, hack, exploit, or use unauthorized third-party software or modifications that affect gameplay;
• disrupt, overload, or attack the servers, the matchmaking system, or other players;
• harass, threaten, impersonate, or abuse other players, or use an offensive, infringing, or misleading username;
• interfere with the Game's normal operation, or attempt to access accounts, systems, or data that are not yours;
• use the Game for any unlawful purpose.

We may suspend or terminate access for any violation of these rules, at our discretion.

5. License & intellectual property

We grant you a personal, non-exclusive, non-transferable, revocable license to download and play the Game for your personal, non-commercial entertainment, subject to these Terms. The HOVERBALL name, logo, art, and branding are owned by us or our licensors.

HOVERBALL's source code is open source and is made available under its own license in its public repository; that license governs the source code itself. These Terms govern your use of the hosted online service, matchmaking, and the official game client and builds we provide.

6. Changes to and availability of the Game

Because the Game is free, we may add, change, suspend, limit, or discontinue any part of the Game — including features, servers, matchmaking, or the Game as a whole — at any time and without liability to you. We do not guarantee that the Game will always be available or uninterrupted.

7. Disclaimer of warranties

THE GAME AND ALL RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE PRESERVED.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOLTER AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE GAME, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE GAME IS PROVIDED TO YOU FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE GAME (WHICH IS ZERO) OR USD $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.

9. Termination

We may suspend or terminate your access to the Game at any time, with or without cause and with or without notice, including for any violation of these Terms. You may stop using the Game and request deletion of your account at any time by contacting support@volter.ai. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Game, except where applicable law gives you the right to bring a claim elsewhere.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for material changes we will provide a more prominent notice. Continuing to use the Game after a change takes effect means you accept the updated Terms.
